WHEREAS, Section 1(2), Article IX-D of the Philippine Constitution provides that the Chairman and the Commissioners of the Commission on Audit shall be appointed with the consent of the Commission on Appointments for a term of seven years without reappointment;

WHEREAS, the same Section of the Constitution further provides that in no case shall any Member be appointed or designated in a temporary or acting capacity;

WHEREAS, the term of the Honorable Guillermo N. Carague, the last appointed Chairman of the Commission on Audit, expired on February 1, 2008 after serving his term of seven years;

WHEREAS, in the precedent-setting case Brillantes vs. Yorac (G.R. No. 93867, December 18, 1990), the Supreme Court ruled that the remaining members of a constitutional body are the proper authority to designate an Acting Chairman thereof pending the appointment of a permanent Chairman by the President of the Philippines with the consent of the Commission on Appointments;

WHEREAS, as of today, February 4, 2008, no permanent Chairman of the Commission on Audit has been appointed to take the place of Hon. Guillermo N. Carague;

WHEREAS, it is imperative that temporary measures be taken so as not to disrupt the operations of the Commission on Audit;

NOW, THEREFORE, considering the foregoing premises and in the best interest of the public service, be it resolved as it is hereby resolved that the functions, duties and responsibilities of the Chairman as Presiding Officer of the Commission Proper and Chief Executive Officer of the Commission on Audit shall be performed and assumed by Commissioner Reynaldo A. Villar, being the senior Commissioner thereat. In the performance thereof, he shall sign as follows:

This resolution shall take effect immediately and shall be automatically revoked upon the appointment of a Chairman of the Commission on Audit by the President of the Philippines.
